Can i take an auto insurance company to court due to diminished value in Florida?

I was rear ended by a vehicle few months ago, and I want to know if I can take the insurance company at fault to court to fight for diminished value, thanks.

Sure you can take them to court… you can take anyone to court. The problem is, can you win and in this case, no… but even if you did it will cost you more that you will receive.

    No you cannot. Florida does not owe for diminished value. Sorry. You are only entitled to the repair cost or ACV (actual cash value) of your vehicle, if it were a total.

    Im not sure about Flordia but I know most other states dont give you replacement cost if the car is over 1 or 2 years old. They will usually give you ACV (Actual Cash Value) or diminished value. Your bumper probably wasnt brand new when they hit it so they arent going to give you a brand new one. So can you take them to court? Yes. Can you win? Probably not…
